Pushing 50 and have been riding since my mon had a cat in 1960, or the same time dad got me my first bike. I ride a helmet in heavy traffic to and from work, but when I am crusing the ol farm roads on my 97 Goldwing at speeds in excess of 40 mph and hate the ol hard hat to the max durning those mornings. I truly think I am old enough to take caution when Im not wearing it. Next the government will be dictating how often I change underwear or what type of gas to put in my bike.

Here in Texas we didn't have a helmet law till a few years ago when D.C. cared so much for our safety that they threatened the Lone Star state to hold funds unless they passed said helmet law into effect. I'm an old fart who is just getting back into riding after being away from it for 30 years. I have osteoarthritis and degenerative bone problems in my neck, but I wear a Shoei full-face when I'm on the highway, when I'm on slow roads close to home in Delaware I choose to ride without the damn thing because after 10-15 minutes I'm in genuine pain. So, I get ticketed by some little rangers in the state parkor not having the brain bucket on my bike. Any pro bono Delaware biker/lawyers out there wanna assist in the fight for freedom of choice. I called the Delaware Secretary of Public Safety about what helemets she approves and got the royal pain in the ass run around, and ended up at a answering machine, where do I go from here ? Anyone ever read the Delaware law? "Every person operating or riding on a motorcycle shall have in his possession a safety helmet approved by the Secretary of Public SAfety and shall wear eye protection approved by said Secretary; provided, however, that every person operating or riding on a motorcycle up to 19 years of age shall WEAR a safety helmet and eye protection approved by the Secretary of Public Safety" Try to remember that this is in a town in Delaware, where the streets have 5 inch deep potholes and ruts and has some bumps that are about 6 inches high and can cause a flat tire. Can you say "Unsafe at any speed"?

I am so impressed - both with your page and with the way the Helmet Law Defense League has elected to deal with the problem that plagues us all. I am a member of A.B.A.T.E. in both Arizona (where helmets are required only for children) and California, where helmets are headaches. I pay dues in both states primarily because I am so strongly opposed to ANY law that serves no legitimate purpose and was passed strictly as a result of ignorance and misinformation being given to legislators who are without first-hand experience. Lots of good, useful information here. I am a seven year rider and try to be an avid defender of motorcyclists' rights. I believe whole heartedly that helmets save lives, but more importantly I believe that those who ride should decide.

I want to warn other bikers to be wary of AIM(Aid to Injured Motorcyclists). The AMA has proof and documentation that AIM has been know to take product liability case against motorcycle manufactures in the name of helping an injured biker. The driving force behind AIM is to generate clientel lists.

If you are interested in defending your right to ride and protecting you constitutional rights join an established organization such as the AMA or ABATE. There are also many state organizations such as the CMRA(Conn. Motorcycle Riders Assoc.) in Connecticut. If anybody out there has any suggestions for me as to what I, as a biker, can do please E-mail me with your ideas. I will be happy to learn more.

I've been an Abate member since the fall of 1990. I've ridden my bike from SoCal to just about every January SAC rally. I've written my letters and visited my legislators. I've supported Abate thru these years, but lately though, I cringe every time I read the Bailing wire. Due to my job situation, making the local meetings is a rare event. I ride a FXSTC a motorcycle designed to be driven only on the highway and at speeds greater than 45 MPH. Can anyone show me where California Law requires anyone to wear a helmet while riding a motorcycle of this design?

I ask this question to divert anyone’s attention from the legalities of the DOT approved helmet to the legalities of the helmet law itself.

I can find where a person is required to wear a helmet while riding a motor-driven cycle, which is any motorcycle with a motor that displaces less than 150 cubic centimeters.

I can find where a person is required to wear a helmet while riding a motorized bicycle or moped, which is a motorcycle that produces less than 2 gross brake horsepower and is capable of propelling at a maximum speed of not more than 30 miles per hour on level ground.

Look at AB7. Look at sec. 27803 of the vehicle code before it was amended through AB7. Look at sec. 27803 of the vehicle code after it was amended. Look at it all carefully again, something is wrong with this picture.

Suppose Dick Floyd (who looks upon a biker as a second rate citizen) and his friends are playing us for stupid. Suppose a particular helmet law does not exist and they are waiting for us to promote and help establish a law requiring a person to wear a helmet while riding any motorcycle. Later the law could be amended to read "any person" instead of "a person".

Think about these three statements:

  • 1."a motorcycle" is a motorcycle undefined
  • 2."any motorcycle" is all motorcycles as defined
  • 3.motor-driven cycles, motorized bicycles or mopeds, are only a few motorcycles of a design that that are not permitted on a California freeway.

I am aware that what I ask and what I say sounds too simple.

Prove that I'm in left field.

There are thoughts to share, but only through a think tank of no bullshit. One must only believe in the "strict language" of the law and how to research it.

As a survivor of an "idiot" who just pulled an F-800 Ford truck in front of me, after impacting the side of the truck in excess of 45 mph with no helmet. Comments: What a great site! I was actually just looking for an up to date list of helmet law states as I am planning my annual end of summer trip. I was blown away by the quanity and fervor displayed here.

As I am traveling through I can't really fight helemt laws in states far away from my home. Thank God and the govenor of Illinois that we have avoided helemt laws so far.

I have my own form of protest: I try not to plan bike trips in helmet law states...and if I'm traveling through, I limit how much I spend to absolute needs. We should all band together and publicise this tactic and hit these states in the wallet.

Anyway, glad to see others share my fervent belief in helmet law choice.

As I am currently a member of NHMRO and have been riding 2 wheeled
vehicles for about 30 years, this subject is near and dear to me.
On of the most enjoyable things I have found upon moving to
New Hampshire 12 years ago is the absence of a helmet law.
Coming from New York originally, I find it quite refreshing to ride
with the wind in my hair (albiet thinning) and have the ability to hear

my peripherial vision is no longer impared.

Comments: Folks, I'm getting more than a little tired of the same old saying; "it should be my choice." It doesn't work that way.

First of all everyone who has a drivers license and rides a bike GAVE UP the "choice" concept the instant you signed for the license! Yeah, thats right, you, I and most others signed a contract with the state. Don't believe me, read the license application form.

Second, the freedom of choice is not going to win in either the courts or the legislature. It is a simple case of money. I.e., if it's my choice to ride free, it is also the taxpayers choice NOT to pay for my medical bills.

NOW, how are we going to kill this idiotic law? We kill it by attacking in the courts utilizing the HLDL and B.O.L.T. idea of "no list, no law." Further, we use the vagueness of the existing statute. The federal decision, Easyriders v. Hannigan is just a stop gap measure. It didn't and won't kill the law, and that is what I want.

Go out and wear anything for a lid, coffee cup, bandana, sunglasses. . .or NOTHING!!!! If ya get a ticket. . .GREAT. Attack in the courts. Yeah, it takes time, effort, money all that stuff. Just remember, it may be your ticket that takes down this law.

FREEDOM IS NOT FREE!!!!!!!

WA and I have seen many a helmet that make me chuckle when
I think of someone putting it on for safety. But I also have
a father that has informed me about some of the accidents
containing street bikes that he has witnessed over the years.
His eyewitness accounts have convinced me to always wear a

For all of those Legislative and Safety & Education Directors out there, the NHTSA has a sub-department called the Bureau of Accident Statistics. These guys keep track of all kinds of traffic-related information. Motorcycle statistics concerning accidents, registrations, alcohol use, etc. are covered in a FREE cd/rom put out by this department. Getting information from the "enemy" (NHTSA) is pretty interesting. While their "facts" may be questionable, the cd gives those of us in the anti-helmet law movement a look at the figures that politicians like to spout all over the place. I don't have the address nearby, but you can look in the Government section of most phonebooks and find a 1-800 number you can call to get an address. The Bureau of Accident Statistics also sends out info quarterly to those interested about any studies and such being conducted in regard to transportation. I've contacted them many times in the past and they've actually been pretty helpful.

Your state Dept. of Transportation does all kinds of traffic studies and such that are free, also. Hey, they're sure as hell not fillin' pot holes here in Illinois, so they've got to do SOMETHING with all of their money.

The courts have stated that anything on one's head that is certified by the manufacturer to be a helmet is a helmet is a helmet until proven otherwise will be the guiding light for "compliance" with the law. As a freedom fighter, I will be wearing the smallest possible helmet (dutifully adonrned with a DOT sticker) this summer, and I will fight to the maximum bounds of legal court process any tickets I receive.I suggest that this be the plan of all bikers across the United States. It's time people start acting naturally and not worry about political correctness. Ride free, ride fast, this is what biking is all about.

Not too long ago a letter was printed in BIKER MAGAZINE which sums up the attitute of many of us:
"Fed Up-- I'm getting a little sick and tired of this long, drawn-out, helmet law fight! Year after year, another law is made against us bikers-- brothers pulled over because their bikes are too fuckin' loud, or their shades ain't on, or they're not the right type of shades, and so on and so forth. Can't anybody see the fact that as long as goofy-ass people keep on buying these stupid skid lids and wearin' them 'cause they think they're safe, the government will have a reason to fuck with us? Look man, quit tryin' to give us bikers a good name in the public's eye. Fuck the public, fuck the damn government! Why are we trying to reason with people who don't give a damn about anybody but themselves? We've got to be ourselves and start kicking some skid-lid-wearing ass! If you coward sons-a-bitches want somethin' over yer skull, buy a fuckin' car! Who do we ride for when we ride our scoots: the government or ourselves? When our brothers fought, what did they fight for? Was it for nothin"? It's begining to look that fuckin' way! Just found out that y'all slammed Proposition 200 in the ass! Great job! For all those who don't know about Prop 200, it was a "no fault" insurance proposal that would have increased insurance rates as much as 800% for motorcyclists. Having to wear a skid lid is bad enough, but paying 800% more for motorcycle insurance would have literally kept thousands of bros from riding, or worse yet, forcing them to ride without insurance altogether. For those of you out on the West coast, the Prop 200 results are probably old news. What can I say? Momma always said I was slow. Regardless of your state, you need to be aware of "backdoor" politicians who want to "protect" us. Similar plans for "no fault" insurance are being reviewed across the country, so do not think that this is just a California thing. Here in the heartland (Illinois), the bikers are pretty solid and up to date on the issues that impact us. I'm not talkin' just about Harley riders, either. ABATE members and non, H-D riders or not have worked to reconstruct our local and state politicians pretty much to our liking. The idea is to become active in your state organization, and organize ANYONE that rides to fight for your cause. Face it folks, bikers are the minority to begin with. We can't practice internal descrimination because of ride, club affiliation, etc. or else we weaken ourselves. Back in 1969, a local biker got a helmet law ticket here in Illinois. Instead of paying the fine and being coerced into wearing a helmet, that biker fought the ticket, (just as many of you bros are doing today). The biker didn't have enough money to mount a defense against the ticket. A local Honda motorcycle shop owner in Belleville, IL by the name of Rich Neb decided that the ticket was bullshit and agreed to pay for the biker's defense. The issue went all the way to the Illinois Supreme Court before a verdict was given. The result? Illinois is the only state in the Union that has declared the helmet law UNCONSTITUTIONAL. The law was repealed and Illinois has been a free state ever since. Do I sound a little puffed up? I guess I am. While I was just entering the first grade, these old time bikers were fightin' for the freedom that I now have today. Is that cool or what?

To sum my lecture up; Keep the faith, persevere and stay informed and active. If you're reading this, you're already active or very close to becoming so. If you don't know where to turn for help, let your finger do the walking.The HLDL,Motorcycle Rider's Foundation, American Motorcyclists Association, BOLT, or your state ABATE organization is an excellent way to get started. Each have their plusses and minuses, but ALL are fighting for your right to ride.

Anyway, been a member of ABATE of Illinois for a while now. The anti-helmet law movement has really taken some weird turns, huh? I'm so glad Illinois got its sh** together in '69 and got rid of the damn helmet law when it did. I hope you guys in helmet law states kick some a** yourselves and lets put an end to this bulls**t once and for all!! I'm glad I found this page. Been lookin' for a place to get good info on motorcycle-related fights throughout the U.S.
WATCH OUT, though, 'cause I think Bikers across are land are fixin' to get screwed by our other "friends" the Insurance Companies. You dudes out in California better turn out in FORCE come election day and defeat that NO FAULT insurance provision your faced with. If that sucker takes effect, you can look at your insurance rates to increase UP TO 500% OR MORE!! Is that nuts, or what!!
One way or another Bikers keep getting the sh**ty end of the stick. I don't know about you, but I'm tired of eating S**T all the time. Maybe it's time to start doling it out.

German citizen, it costs about DM 5000 just to get a license
, and that is restricted to smaller bikes (<250cc). They

Most of the people I will be speaking to really don't know the issues behind helmets. I think it should be every man or womans responsibility to choose the protection they feel that they need, and not for some one else to decide for them. We rode out to sunny Calif last summer (in August), from Michigan.
Having to wear a helmet didn't make last summer's heat any easier to take.

Comments: I had a motorcycle accident 6-26-94. A Lady pulled out in front of me and I laid a new Harley FHLS down and skidded 7 feet on my side into her car.
My speed was about 40 MPH. My head hit the side of the her car. I received a basal skull fracture amoung other injuries. But you ought to have seen the helmet.
That Harley half helmet saved my life, so say the doctors that treated me. I was a fighter pilot in the USAF and I wouldn't ride a motorcycle
without a helmet. Beleive me I owe my life to my helmet. I cannot believe any law would govern my decision to protect my head. I would be careful
to select a good quality helmet. My Harley was totaled and her car was also totaled. I was 60 years old at the time of the accident. I owned Harleys for many years
but they were all used and this was my first new pride and joy. Milage on the bike was 5806 at time of accident.
My doctor put me on disability and will not allow me to go back to work. . I have been an engineer for 40 years.
