I have been riding for 35 years and i'm in the 200,000 mile club by now and have never had any type of motorcycle accident of any kind. There was only one time I was cut off at an on ramp to an express way and I avoided that without any problem even with my wife on the back. I have raced bikes with helmets on and found them to be a hindrance both with my vision and comfort. The wind has an effect on the helmet and there are many more down side that I don't have to mention to you I'm sure. To think that riding with a helmet make one safer is false security. You and your awareness are your best and only security. After all these years that is my conclusion. There are those that disagree but by in large they do not ride motercycles at all. I live in IL. and we don't have to wear one so I feel lucky in that respect. My best defense is to be a defensive driver.

Thanks for fighting for personal freedoms. Helmet laws are immoral. After all this is the land of the free is it not? I have been riding for approx. 35 years, some with a helmet, most without a helmet. I can agree that helmets can save you from serious injury, I absolutely, disagree with the premise of forcing a person to wear a helmet, by law. I support the personal choice to wear a helmet, i always have and always will. I used to live in Wisconsin, and was active in repealing that states helmet law, which can be done in any state, if a concerted effort is made by every registered motorcyle owner in the state. Politicians listen to numbers, so fill their email boxes with your thoughts on helmets.

Great Website. I turned 55 last year, bought a Sportster, took the safety course and passed my motorcycle test and started riding. Now I ride a Fat Boy and love every minute. In Saskatchewan, Canada, we are forced to wear helmets. Does anyone know if this defense of non specific requirements would work up here? As soon as we get into North Dakota and head south the helmets come off at the border. I agree that thosse who ride should decide.

Love the site and the approach to the issue. I dson't wear a helmet all the time, but do wear one probably 90 percent of my riding miles. That's mainly out of habit -- I rode in Europe for the two years I live there -- And they make great protection when traveling in cool or inclimate weather. I always make my wife and kids wear a helmet when riding with me. I don't beleive helmets are some sort of magical protection, but I have benefited from them in the couple crashes I've experienced. I'm a big fan of helmets, but a law requiring helmets is as contrary to freedom of choice as can be. It should be my call, not the government's. Helmet laws are simply designed to save insurance companies money. Insurance companies have managed to pass laws requiring everyone to have liability insurance on all vehicles. The europeans are starting some new designs of scooters that have tops and keep you out of the weather. Our government won't even allow them to be sold in this country, buy virture of emission laws. What puts out more emmissions. A 250cc four stroke or an SUV. Absolutely ludicrous. This is the way of the future. Even if gas goes up to five bucks a gallon you wont be able to buy something like this because this stupid government wont allow it. How did you vote this last election??? Was riding most of the summer with "NO" helmet on or on the bike. Got pulled over twice by our local law enforcement here in Portage, MI. The first officer ask me to go get my helmet and let me go, thinking I was nuts or just didn't give a rip. The second wrote me a fix-it ticket because he thought the tread on my front tire was to thin. So, how does one get a "NO" helmet ticket around here anyway? hehehe!

(I thought this was the most sensible way to write a rebuttal to Mr. Q -- yet I really wouldn't mind if you erase this one, pal!)

Thank you for your comments, your readers will appreciate them. You should not laugh at my spelling nor anybody else's for the matter (I do write babies and not babys) because English is not my first language, nor is America my motherland. I just happen to be here and voluntarily ride with a helmet (you know, Florida law with the $10,000 PIP insurance...).

But your point is of interest too: you are entitled and encouraged to criticize your mandatory schooling, yet you cannot really dump it as if it had no significance. If you don't have the slightest trust in your institutions (e.g. the NHTSCA), you don't have much more wisdom that the one who's in complete awe of them (not me, don't worry) and is ready to kill some kids on the other side of the planet because they don't think like the big guys in suits up there in the WH (just an example of an institution that people like to waffle about). Some way along the line I would be inclined to believe more in those institutions that you are so eager to compare to Santa Claus and the Tooth Fairy than some drivel found randomly on the internet. Of course, you could very well convince me that they are the baddies, and you're the one defending *my* own personal freedoms. But to substantiate scientific evidence one has to be a pretty good scientist don't you think? In total honesty (being a scientist myself), I find the enclosed documents to be rather unconvincing. But let's forget about facts (the argument will never end) and let's talk about the spirit of it all.

I *really* admire you guys for taking such a stand against politics and defend *your* rights. There's some revolutionary attitude that is almost awesome. But doesn't your freedom stop where your neighbor's start? Can you really see politics as an abstraction of the community that focusses on the individual's right? Riding with a helmet (or not) has more to do than what you and I want to do with it. In fact, we not only disagree on why we should or should not have a piece of polycarbonate over our skull, but we disagree on how we both should fit in society (yes I do not live in the North Pole with Santa). Maybe I'm just living in the wrong country... (any foreigners out there? or am I the only zealot left?)

People of the State of California v. Patrick G. Bristol

Having been in court several times by myself, I'm surprised that all he got was a guilty on the helmet. He was argumentative and obnoxious to the court. I'm surprised he didn't get fined for contempt.

He would have been much better off to have kept it sweet and simple. The judge used to ride. He could have been on PGB's side. His drawn-out questioning and repeated questions just irritated the court, losing any support he would have had.

A much better line would have been: Establish that there are standards for exhaust sound levels, with dB(a) values. This is a distinct value, like his comparison to speed limit, and not an opinion such as "I think it was too loud."

The officer had no measuring equipment, so was incapable of determining if PGB was violating the statute.

This would have determined that the officer stopped him without cause AND no way to determine cause. That is where I think he was trying to go, but really muddling it.

Leaving the helmet home was really dumb. He should have brought in a helmet. 99% of the time, the officer can't tell if you are the person, and only assumes because someone says you are. Any helmet that looked halfway like his (if his was indeed illegal) would have shown the court a helmet and then it could have been checked for the appropriate stickers (Snell, Z09, DOT, etc.) which he would have had.

Actually, many bike rallies and shows sell all the stickers, if they weren't there.

As soon as the court saw the helmet and saw the stickers, it would have been dropped. 15 minutes to 30 minutes. Dragging it out made the court mad and in the transscript makes PGB really look dumb.

Grandstanding and dragging it out is fine for a real attorney like Steve Bianco, but it gets us normal citizens in trouble.

While making it less profitable to the state is a good idea to get the helmet law turned around (two hours for a puny fine), PGB still lost and now has to go for appeal. The state didn't get a puny fine, they got double the maximum. This isn't smart or effective in anyone's book.

Going in and winning in 15-30 minutes would have been even more effective since the court and the police would have had the expense without any fine to pay for it. And PGB would not have paid a dime.

If you want 100 more like Mr. Bristol, you have a long wait. Each has to spend a few hours, pay a big fine, and then spend a few more hours.

You are more likely to get a few hundred if they can go in, get the ticket dropped in 15 minutes, and leave -- with no cost to them.

If Mr. Quigley had been to school (or should we repel school laws in the US because we should be free to choose to be educated?) he would not have jumped to the conclusion that "NHTSA does not know if it is unsafe for a person to wear a helmet". It clearly means that it has tested that "the effects of the weight of the helmet HAVE BEEN TESTED on all age groups without makeing a DIFFERENCE between age groups". NHTSA guys are obviously smarter than you think...

"NHTSA does not, and will not, EVER have a list of approved helmets". Sure, let's hire an army of government employees to work in Japan and check if Shoei's and Nolan's helmets comply with federal regulations. And let's also publish a list of approved cars, beer mugs, clothes (since the law forces us to wear clothes, maybe we should distinguish between clothes and none-clothes, such as bikinis or foreign folkloric costumes...) etc. OF COURSE it doesn't have a list, get a grip!

People who are dumb enough not to wear a *proper* helmet will kill themselves on the road, but will anybody regret them? We don't need helmet laws. That's the only thing I agree with.

Care about your family: wear a helmet.

Your pseudo-scientific explanations remind me of the creationists trying to show that the earth was created 65,000 years ago. It's very amusing. But now it's time to be adults. Leave science to scientists and just enjoy the ride.

Gentlemen: if your neck was broken because of your helmet, I advise you to choose a better helmet next time. Not to blame politician, lawmakers or cheap helmet manufacturers. How immature.

Thanks to HLDL and ABATE to continue to fight against the government trying to meddle in someones right to choose. If I lived in a helmet law state you would be losing one of your road brothers. Between the humility of doing what I am told and the discomfort of wearing one, I would pass on riding to save the price of upkeep on my ride and insurance, my own safety net. Was involved in motorcycle vs mini van. Had helmet on. Result was, amoung other injuries, a broken neck. I believe it was broken because of the helmet. Sometimes wonder if I would have sustained brain injury if not wearing a helmet. Which is the lesser of the two injuries? It has been 16 months since. I was reading through your site and saw that you do not mention the District of Columbia. I was busted for not wearing a helmet last Friday, cited 25 bucks and harrassed for about half an hour in my own driveway. Sad thing is I wasn't even on my cruiser. I was on my 50cc Honda runabout. I've called DC DMV, DC Traffic Court and DC MPD Traffic Enforcement Division and know one can tell me specifically what the law is or where I can read a text of it. Arkansas, an "embarassment to the community" of motorcyclists? Simply because we as bikers had to compromise for a short period of time on the 18 vs. 21 years of age issue we are being considered an embarassment to the "community"? Fuck'in get over it! We were damned lucky to have gotten the helmet laws changed at all. Beleive me, it was certainly not an easy task. In fact (as I understand it), we were basically out of funds for our fight and had to either "take it or leave it" in regard to any sort of repeal at all. On top of that, Arkansas law considers 21 to be of "accountable age" on some issues. When the goverment gets something like an age restriction in their head, it ends up being "the norm instead of the exception". Perhaps you would like to make a worthy monetary donation to our state's ABATE to continue the fight against helmet laws. Our funds are being built back up for our next step toward EVERYONE riding in our state to be able to make the helmet/no helmet choice for themselves. We (Arkansas bikers) may not ever get the helmet law completely repealed, but the fight is NOT over!

I recently moved to TN. from Fl and cannot belive TN. has not like so many other states figured out that helmets should be worn by those who wish to wear them and not everyone wishes to wear them. I do belive a rider should 1. wear a lid untill age 21 2. have at least 3-4 years riding 3. wear a lid only if he chooses to. TN. should take a look at some of the other states w/o lid laws and what affect it has in those states over motorcycle deaths. Yes, everyone should have a choice to wear a motorcycle saftey helmet. I'm MSF trained and ride year round. Oh, I'm middle aged and the caregiver to my wife who has Multiple Sclerosis. I agree that in America everyone has a right to their own opinion, but let's get back practical common sense. In some circles of America it may be DUMB to ride and enjoy motorcycling, but in my own first hand experience it DUMBER to ride without certified SNELL helmet. Caregiving for a person who is confined to a bed gives me insight to where I don't want to end up after a crash. Oh, did I mention CRASH. Earlier this month and after a few decades of mostly problem free riding, I took a 35-40 mph get off hard from my BMW R900. You can talk about "Liberty" but I glad to be educated enough to wear a Shoei RF-700. The helmet did what is was designed to do... SAVED MY BRAIN. I don't want to join my wife in her hospital bed, not doing something I really enjoy -- motocycle riding. So with that said, you anti-helmet people - do what you do. For me, I'm supporting my local MSF cycle classes and watching my four sons, with safety helmets, enjoy sports riding. RIDE SAFE, RIDE WITH A CERTIFIED MOTOCYCLE HELMET !

The Commerce and Government Committee heard testimoney 17 March on HB1185. I was there and I want to thank each motorcyclist that came out to show support for the bill. There were 13 who testified for and 9 who testified against. It is a shame that the opponents had to use a victim to get their point accross. But what was interesting and keep your ears open. The victim kept referring to his "full face helmet" He made reference to his "full face helmet" at least 7 times. If the bill is upheld could this be the next bill for motorcyclists to wear only full faced helmets....Something to ponder. I commend all those who testified for the bill again testimony given was excellent.

Having been involved in a motorcycle accident, which was the fault of some real bad maintenance on my ride by a Harley-Davidson dealership in Wisconsin, 5 years later I'm going to court. The godamn insurance company that represents the dealer is refusing to pay for damages incurred by myself because I wasn't wearing a helmet. It has been proven by my lawyers that the mechanic that worked on my scoot for the 40,000 mile checkup really,really screwed up. GREAT WEB SITE I live in Georgia and have 4 helment law tickets. One has been dismissed and 3 are still pending bench trial. I go to trail in Gwinette County Feb 11 at 1:30. I have a pretty good defence planned. This will be the first hearing in gwinette about helment laws. There are probley a half dozen other people with tickets in gwinette and mine will be the first heard. The district attorney is playing hard-nose and I dont have money for a attorney. They were turned over for bench trial back in Sept. But guess what,the tickets have seemed to disapear. The wheels of justice at its best. There are probley 1OO+ tickets here in Georgia because of the NO LIST NO LAW.since last summer and the DOT is running around like a bunch of roaches trying to figure something out. It is a joke over here in GA. with what all you hear about the court system and the DOT involing this law and the BS they are trying to push on us to make the law enforceable. One guy even got a year probation and another man was fined $35o dollars. Those two judges dont give a damm about the law, only their law.Remember NEVER GIVE UP WHEN IT COMES TO OUR FREEDOM. Excellent site!! I'm moving from Florida to the L.A. area next month and now have a better idea of what I am going to have to put up with as far as helmet laws, etc., are concerned. I've been on Harleys for over thirty-five years and wear a "beanie". On my BMW (not a yuppie), I wear a 3/4 Bell 500. How about proposing that ALL passengers/drivers in ALL motor vehicles wear an "approved" helmet? After all, cages folks suffer head injuries too. Oh, yeah, how about NASCAR roll cages and seat belt harnesses for them too? And, don't forget the Nomex fire retardent suits. Smile. They are gonna get sooner or later.
